    This complaint filed by the Swiss Watch Industry to the European Court resulted in an order to Google:

    The Federation of the Swiss Watch Industry (FH) had been focusing on customs seizures and encouraging foreign governments to act against manufacturers and importers but really kicked up their scrutiny of internet sales sites from about 2015. On the prevention side, they've been running a rather feeble campaign with the emphasis on "buying responsibility", associating fake watches with organized crime. A more subtle angle has been to link fakes with theft of intellectual property, casting themselves in with musicians, artists, actors, etc., who's original works are ripped off without compensation.

    Firstly I'd be very surprised if ANY of these sites are hosted in the Benelux countries. Same with Google. So, the way I see it - this will only affect Google where the listed domains will be omitted from the search results. But this ruling can be defeated in 5 seconds by someone with the know-how. In fact, if you copy and paste any web address from the list they still exist today (I only tried about 1/2 dozen) Not that I condone what they are doing or ever used any of these sites. I'd discourage anyone from throwing their money away virtually for nothing. But the thing is, we mostly live in so called free countries - free speech, free religion, etc, etc. If someone wishes to purchase a bad copy of something I say let them.

    Purchasing for your own use is down to the individual and how they feel about wearing a rip off watch.

    Purchasing one and then trying to pass it off as real to some poor unsuspecting punter on eBay is what I can’t stand, and is the reason why the fakers should be removed full stop.

    Yes, it seems strange -but then, everything on the judicial system Internet-related tends to look strange.

    I just had a look to one of those domains I chose randomly, and it looks like it has no relationship with Google at all, so Google is not in place to do anything of what gets requested in the order: Google can't "discontinue its services in the Benelux countries in respect of the (sub)domains listed in Exhibit 3, by closing, and keeping closed, such (sub)domains for visitors from the Benelux countries, and to discontinue, and not resume, its hosting of those websites". since Google neither controls firewalls, nor DNS service, nor hosts these sites itself.

    I can think of some reasons on why is this requested to Google and I don't like any one of them.

    Yeah, fakers should be removed - amen. When you check out any of those places on the above list you know you're buying a replica because it says so. You're unlikely to buy any of those on the eBay because they do not allow replicas. Fakes can be reported to eBay. But surely, you're not suggesting that ALL those people with franenkwatches on the eBay are Chinese?

    Have you any experience going this route? I used to do it but, after a few times when the items remained listed and sold, I followed up to learned they will not pull a listing of a fake branded watch (or anything else for that matter) unless the intellectual property holder makes the complaint. If you dig, you can find the process required by ebay called Verified Rights Owner Program. And still the responsibility is with the copyright holder to patrol ebay for violations.

    Importing a fake into your country is a Customs offence regardless of intended use. Chances of a Border Force pursuing a criminal case for one watch seems unlikely but if you have job which requires personal integrity or where a future employer might run a search, then it might not be the best chosen risk.

    I have reported many fakes to eBay and have yet to see a single one removed.
